3. Site access and terms of use

The site is freely accessible to any user with internet access. All costs associated with accessing the service — hardware, software or internet connection — are borne exclusively by the user.

Hymeria reserves the right to modify, suspend or discontinue all or part of the site at any time and without notice, for maintenance, updates or any other reason, without this giving rise to any compensation to the user.

The user undertakes to use the site for its intended purpose, in accordance with applicable laws and regulations, and not to infringe the rights of third parties or public order.

4. Intellectual property

4.1 Site content

All elements that make up the site — including, without limitation, its general structure, texts, analyses, studies, methodologies, reference frameworks, diagrams, illustrations, photographs, graphics, brand identity, logos, trademarks, sounds, videos, software, databases and all other content — are the exclusive property of Hymeria or its partners, and are protected by the provisions of the French Intellectual Property Code, in particular copyright, trademark law, design law and the sui generis database right.

4.2 Licensed rights of use

Hymeria grants the user a non-exclusive, non-transferable, revocable license to consult the site's content for strictly personal, non-commercial purposes. Any reproduction, representation, modification, adaptation, translation, distribution, public communication or exploitation, in whole or in part, of the site's content, by any means and on any medium, is strictly prohibited without Hymeria's prior written authorization, on pain of constituting infringement sanctioned by Articles L.335-2 and following of the French Intellectual Property Code.

4.3 Trademarks

The "Hymeria" trademark, its logotype and, more generally, all figurative or non-figurative trademarks and other distinctive signs present on the site are and shall remain the exclusive property of Hymeria. Any reproduction, use or display of these marks, alone or in combination, without prior express authorization is prohibited and engages the civil and criminal liability of its author.

5. Personal data protection

Hymeria attaches paramount importance to the protection of the personal data of its users, clients, prospects and partners, and undertakes to process such data in accordance with Regulation (EU) 2016/679 of April 27, 2016 (the "GDPR") and French Law No. 78-17 of January 6, 1978 as amended, known as the "Informatique et Libertés" Act.

Personal data is shared with authorized internal teams of Hymeria and, where applicable, with its processors acting on its instructions (hosting provider, email tooling providers, CRM, audience analytics, artificial intelligence). Hymeria contractually frames these relationships in accordance with Article 28 of the GDPR and requires a level of protection equivalent to its own.

5.5 Transfers outside the European Union

Some data may be transferred outside the European Economic Area. In such cases, Hymeria ensures that these transfers are framed by appropriate safeguards within the meaning of Articles 44 et seq. of the GDPR (adequacy decision, European Commission Standard Contractual Clauses, Binding Corporate Rules).

5.6 Retention periods

Data is retained for the period strictly necessary for the purposes for which it is collected, extended where applicable by retention periods imposed by law (notably for accounting, tax and evidentiary purposes). As a guide: contact requests are kept for three (3) years from the last contact for B2B prospecting purposes; data related to client relationship management is kept for the duration of the contractual relationship, then archived in accordance with applicable legal obligations.

5.7 Rights of data subjects

In accordance with Articles 15 to 22 of the GDPR, every data subject has the following rights: right of access, right to rectification, right to erasure ("right to be forgotten"), right to restriction of processing, right to portability, right to object, right to withdraw consent where processing is based on it, and the right to give instructions on the fate of personal data after death.

Data subjects also have the right to lodge a complaint with the French data-protection authority CNIL, 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France — www.cnil.fr.

5.8 Security

Hymeria implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, in accordance with Article 32 of the GDPR, notably as regards confidentiality, integrity, availability and resilience of processing systems and services.

6. Cookies and trackers

The site may use cookies and other trackers within the meaning of Article 82 of the Informatique et Libertés Act and CNIL guidelines. Some cookies are strictly necessary to the operation of the site and do not require consent. Others — notably for non-exempt audience measurement, personalization or social sharing — are only set after collecting the user's free, specific, informed and unambiguous consent through the information banner shown on the first visit.

7. Use of artificial intelligence

Hymeria defines itself as an AI-augmented strategy consulting firm: our engagements combine the expert judgment of our consultants with the contribution of artificial-intelligence tools (hereinafter "AI"). This section describes our approach and the associated safeguards, in the spirit of Regulation (EU) 2024/1689 of June 13, 2024 laying down harmonized rules on artificial intelligence (the "AI Act") and the GDPR.

7.1 Nature of the systems used

As part of its services and, where applicable, on the site, Hymeria may use various AI systems, including: (i) generative AI models to produce syntheses, analyses, visuals or preliminary proposals; (ii) data-analysis tools for exploration, classification and modeling; (iii) conversational assistants for documentary research. These tools are deployed as third-party components or developed in-house.

7.2 Principle of human oversight

Any output from an AI system in the context of Hymeria's engagements is subject to human review by a qualified consultant who checks its relevance, consistency, the truthfulness of the sources used and the alignment with the scope of the engagement. The final judgment, recommendations and binding deliverables of Hymeria fall under the responsibility of its consultants and partners, not the AI itself.

7.3 No fully automated individual decisions

Hymeria does not make any decision producing legal effects on data subjects, or significantly affecting them in a similar way, based solely on automated processing, within the meaning of Article 22 of the GDPR. All significant decisions involve substantial human intervention.

7.4 Confidentiality and no training

Personal data and confidential client information are not used to train third-party AI models for commercial purposes. When Hymeria uses external models, it prioritizes contractual offerings excluding training on submitted content ("no-training clauses") and governs these processings through subprocessor agreements compliant with Article 28 of the GDPR. Internal instructions specify the types of data that may be shared with each tool.

7.5 Fairness, transparency and quality

Hymeria informs its clients, within each engagement, of the use of AI tools and, where relevant, of the associated limitations. Deliverables likely to contain AI-generated or AI-assisted elements are identifiable internally and undergo reinforced quality control. Hymeria endeavors to assess the risk of bias and to limit its effects through source diversification, methodological challenge and validation by human expertise.

7.6 Inherent limits of AI systems

The user and client are informed that, despite the precautions implemented, AI systems may produce inaccurate, incomplete or outdated results ("hallucinations"), reflect biases stemming from their training data, or evolve in their performance. No content produced with AI assistance on this site shall, in the absence of express written validation by Hymeria within a contractual engagement, constitute legal, tax, financial, medical or professional advice binding on Hymeria.

7.7 Specific rights

In accordance with the AI Act and the GDPR, any data subject may request additional information from Hymeria on the use made of AI systems concerning them, exercise their right to object and request human intervention. Such requests should be sent to contact@hymeria.com.

8. Hyperlinks

The site may contain hyperlinks to third-party sites operated by persons independent of Hymeria. These links are provided for information only; Hymeria exercises no control over the content of these sites and cannot be held responsible for their content, operation or any use that may be made of them.

Creating hyperlinks to the site is subject to Hymeria's prior written authorization. Hymeria reserves the right to request the removal of any link it deems inconsistent with its image, values or rights.

9. Limitation of liability

Hymeria endeavors, to the extent possible, to ensure the accuracy and currency of the information published on the site, the content of which it reserves the right to correct at any time and without notice. However, Hymeria cannot guarantee the accuracy, precision, completeness or currency of the information made available.

Consequently, Hymeria disclaims all liability: (i) for any inaccuracy, imprecision or omission relating to information available on the site; (ii) for any damage resulting from a fraudulent third-party intrusion leading to a modification of the information made available; (iii) and more generally, for any direct or indirect damage, whatever its cause, origin, nature or consequences, arising from anyone's access to the site or inability to access it, as well as from the use of the site or reliance on any information derived from it.

The information published on the site is general in scope and cannot, on its own, serve as personalized advice. Only a contractual engagement formalized in an engagement letter or master agreement signed with Hymeria binds Hymeria with respect to its consulting services.

10. Governing law and jurisdiction

This legal notice is governed by French law. Any dispute relating to its interpretation or performance shall fall, in the absence of a prior amicable settlement, within the exclusive jurisdiction of the courts within the territorial scope of the Court of Appeal of Versailles, notwithstanding multiple defendants or warranty claims.
