These Terms of Use (the "Terms") govern access to and use of the website www.hymeria.com (the "Site"), published by Hymeria, a Société par Actions Simplifiée (French simplified joint-stock company) with a share capital of €1,500, registered in the Nanterre Trade and Companies Register under number 103 861 910, whose registered office is at 177, route de l'Empereur, 92500 Rueil-Malmaison, France (hereinafter "Hymeria" or "we").

The Site is an informational website presenting the firm's activities, offerings, publications and contact details. It does not provide access to paid online services or to a client portal.

Accessing and browsing the Site implies full, unreserved acceptance of these Terms. Anyone who does not accept these Terms must refrain from using the Site. Hymeria reserves the right to amend the Terms at any time; the version that applies is the one in force at the time of the visit.

The purpose of these Terms is to define the conditions and procedures for accessing the Site, the rights and obligations of users, and the rules applicable to the content published by Hymeria, including its publications, viewpoints and studies (the "Content").

The Site is freely accessible to anyone with internet access. All costs associated with such access (hardware, software, internet subscription) are borne exclusively by the user.

The Site is accessible 24 hours a day, 7 days a week, subject to force majeure, technical issues or maintenance operations. Hymeria reserves the right to suspend, interrupt or modify access to the Site at any time and without notice, without such interruption giving rise to any compensation.

2.2 Technical compatibility

The user acknowledges having the skills and means necessary to access and use the Site. It is the user's responsibility to check that their equipment configuration is compatible with the Site and to take all appropriate measures to protect their data, in particular against the risks associated with the use of the internet.

The Site is made available to the user for information about Hymeria's activities, offerings, publications and contact details, and to enable users to get in touch. Any use of the Site must comply with these Terms, with applicable laws and regulations, and with the rights of third parties.

4.1 Site content

All elements that make up the Site — general structure, texts, analyses, studies, viewpoints, methodologies, diagrams, illustrations, photographs, graphics, logos, trademarks, sounds, videos, software and databases — are the exclusive property of Hymeria or its partners, and are protected by the French Intellectual Property Code, in particular under copyright, trademark law, design law and the sui generis database right.

4.2 License to use

Hymeria grants the user a strictly personal, non-exclusive, non-transferable, revocable license to consult the Site's Content for private, non-commercial purposes. This license does not entail any transfer of intellectual property rights.

Any reproduction, representation, modification, adaptation, translation, extraction, reuse or exploitation of the Content, in whole or in part, by any means and on any medium, is strictly prohibited without Hymeria's prior written authorization, on pain of constituting infringement sanctioned by Articles L. 335-2 and following of the French Intellectual Property Code.

4.3 Publications and viewpoints

Publications, studies, opinion pieces and viewpoints distributed on the Site are works of authorship protected by copyright. Any citation or reference to these works must be accompanied by an express mention of the author and of Hymeria, with a link to the original source. Full reproduction, even with mention of the source, is subject to prior authorization.

4.4 Trademarks

The "Hymeria" trademark, its logotype and all distinctive signs present on the Site are the exclusive property of Hymeria. Any reproduction or use without express authorization is prohibited and engages the liability of its author.

5. Content generated by artificial intelligence

Hymeria uses artificial-intelligence tools in the production of some Content published on the Site (syntheses, analyses, preliminary illustrations). In line with its ethical commitments, any AI-assisted content is validated by a qualified consultant before publication.

Content published on the Site is general and informational in nature. It does not constitute, in the absence of a formal contractual engagement with Hymeria, legal, tax, financial, strategic or professional advice binding on Hymeria. Because AI systems can produce inaccurate or incomplete results, the user is invited to verify important information against competent sources.

6. Hyperlinks

6.1 Outbound links

The Site may contain links to third-party sites. These links are provided for information only. Hymeria exercises no control over the content of these sites, does not endorse them, and cannot be held responsible for their content, their availability or any damage that may result from their consultation.

6.2 Inbound links

Creating any hyperlink pointing to the Site is subject to Hymeria's prior written authorization. This authorization may be revoked at any time. In any case, links to the Site must respect Hymeria's image and values, and may in no case suggest a partnership, recommendation or endorsement by Hymeria.

7. Liability

7.1 Accuracy of information

Hymeria endeavors to ensure the accuracy and currency of the information published on the Site. However, it cannot guarantee the completeness, precision or currency of that information. Content may evolve without notice. Hymeria reserves the right to correct or remove it at any time.

The collection and processing of personal data carried out via the Site is governed by Hymeria's Privacy policy, accessible from the Site footer and constituting a document separate from these Terms.

By browsing the Site and using the contact form, the user acknowledges having read this Policy and accepts the processing described in it, within the conditions and limits specified therein.

10. Governing law and jurisdiction

These Terms are governed by French law.

Any dispute relating to their interpretation, validity or performance shall be submitted, in the absence of a prior amicable settlement, to the exclusive jurisdiction of the courts within the territorial scope of the Court of Appeal of Versailles, notwithstanding multiple defendants or warranty claims.

Hymeria reserves the right to modify these Terms at any time, without notice, in particular to comply with legal, regulatory, case-law or technical developments. The applicable Terms are those in force at the time of the visit to the Site, as published with the last-updated date.

Continued use of the Site after modification of the Terms constitutes acceptance of the new conditions. It is the user's responsibility to consult the Terms regularly.

12. Miscellaneous

12.1 Entire agreement

These Terms, together with the Privacy policy and the Cookie policy, constitute the entire agreement between the user and Hymeria regarding the use of the Site. They supersede any prior agreement on the same subject.

12.2 Severability

If any provision of these Terms is declared null or unenforceable by a court decision, the other provisions shall remain in force and retain their full effect.

12.3 No waiver

The fact that Hymeria does not assert a provision of these Terms at a given time shall not be interpreted as a waiver of the right to assert it later.
